Welcome to EconoCrafts. These Terms and Conditions (“Terms”) govern your use of the EconoCrafts website (EconoCrafts.com) and any purchase of products from our online store. By accessing our site or placing an order, you agree to be bound by these Terms. If you disagree, please discontinue use of the site. We are committed to clarity and fairness, so please read these Terms carefully. For any questions, contact us using the information in Section 14 below.

1. Acceptance of Use and Eligibility

1.1 Acceptance of Terms: By using this website, you indicate that you have read and agree to these Terms, as well as our Privacy & Cookies Policy (incorporated here by reference). These Terms apply to all visitors and customers of EconoCrafts. Continued use of the site after any changes to these Terms constitutes acceptance of those changes.

1.2 Age Requirement: You must be at least the age of majority in your state or province of residence to use this site or make a purchase. By using EconoCrafts.com, you represent that you meet this age requirement. If you are a minor, you may use the site only with the involvement and consent of a parent or guardian.

1.3 Changes to Terms: EconoCrafts may modify these Terms at any time. We will update the “Effective Date” at the top when we do so. It is your responsibility to review the Terms periodically for updates. If you continue to use the site after changes are posted, you will be deemed to have accepted the revised Terms.

2. User Accounts and Conduct

2.1 Account Creation: Some features (like placing orders or creating wish lists) may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update your account info promptly if it changes. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

2.2 Account Security: If you suspect any unauthorized use of your account or a security breach, you must notify us immediately. EconoCrafts is not liable for any loss or damage arising from your failure to safeguard your account information.

2.3 Acceptable Use: When using our site, you agree not to engage in any of the following prohibited activities:

  • Unlawful Activities: Do not use the site or purchase products for any unlawful purpose, or to solicit others to perform illegal acts.
  • Violation of Laws or Regulations: Do not use the site in breach of any applicable federal, state, local, or international law or regulation.
  • Infringement of Rights: Do not infringe or violate EconoCrafts’ intellectual property rights or the rights of others (including copyrights, trademarks, and privacy rights).
  • Harmful Behavior: Do not harass, abuse, insult, harm, defame, intimidate, or discriminate against anyone, and do not post or transmit any obscene or objectionable content on the site.
  • Interference and Hacking: Do not interfere with or circumvent the security or functionality of our website. This includes prohibitions on introducing malware or any destructive code, attempting to gain unauthorized access to our systems, or breaching the website’s security features.
  • Data Mining: Do not use any automated means (e.g., bots, scrapers) to collect data from the site or to access the site for any purpose not authorized by EconoCrafts. Any form of data extraction or “scraping” of our content is prohibited.

EconoCrafts reserves the right to terminate or restrict your access to the site and services at our discretion if you violate any of the above rules or any other provision of these Terms (see Section 8 on Termination).

2.4 Right to Refuse Service: We reserve the right to refuse service, cancel user accounts, or restrict access to the site to anyone at any time, for any reason. This includes the right to block or remove users who engage in fraudulent activities, abuse the site, or violate these Terms.

3. Intellectual Property

3.1 Ownership of Content: All content on EconoCrafts.com – including text, product descriptions, graphics, logos, button icons, images, audio clips, downloads, and software – is the property of EconoCrafts or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The compilation of all content on this site is the exclusive property of EconoCrafts. All company names, logos, product names, and slogans on the site are trademarks or service marks of EconoCrafts or its affiliates/suppliers, and are protected by trademark laws.

3.2 Limited License: EconoCrafts grants you a limited, revocable license to access and make personal use of our website for shopping and informational purposes. No other use is permitted. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our site without our prior written permission. Any unauthorized use terminates the permission or license granted by EconoCrafts.

3.3 User-Generated Content: If you submit any content to our site (such as product reviews, comments, photos, or other feedback), you grant EconoCrafts a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, translate, and display such content in any media. You represent that you have the right to post or submit any content you provide, and that such content does not violate any of these Terms or any law. We reserve the right (but not the obligation) to remove or edit user-submitted content for any reason.

3.4 Intellectual Property Complaints: EconoCrafts respects intellectual property rights. If you believe that any content on our site infringes your copyright or other IP rights, don't hesitate to get in touch with us at the address in Section 14 with the relevant details. We may remove content at our discretion pending further investigation.

4. Product Information and Pricing

4.1 Product Descriptions: We strive to ensure that product descriptions, photographs, pricing, and availability information on our site are accurate and up-to-date. However, mistakes can happen. EconoCrafts does not guarantee that all product descriptions or other content on the site are error-free, complete, or current. If we discover an error (e.g., a mispriced or misdescribed item), we reserve the right to correct it and to update or cancel any orders placed for that item as described in Section 5. We also reserve the right to modify information or cancel promotions at any time without prior notice.

4.2 Color and Appearance: We attempt to display product images and colors as accurately as possible. However, we cannot guarantee that your device’s display of colors will be accurate, as screens and settings may vary.

4.3 Pricing: All prices on our site are listed in U.S. dollars (unless otherwise noted) and are subject to change at any time. Prices do not include applicable taxes, shipping fees, or other charges, which will be added at checkout. We may offer promotions or sales from time to time; such offers are for a limited time and subject to specific terms. We reserve the right to end promotions or adjust prices early and without notice at our sole discretion.

4.4 Taxes: You are responsible for any sales, use, or other taxes or duties applicable to your order. These may be added to the total price of your purchase during the checkout process, depending on your shipping location and tax laws.

4.5 Availability: Product availability is indicated on the site where possible. We cannot guarantee that an item listed as “in stock” will remain available by the time you attempt to purchase it, as inventory can change quickly. In the event a product you ordered is unavailable or out of stock, we will inform you and may cancel the order (with a full refund) or provide alternatives if available.

5. Orders and Payment Terms

5.1 Offer and Acceptance: Placing an order on EconoCrafts.com constitutes an offer to buy the products in your cart. Your order is considered accepted (and a binding contract formed) only when we process and ship the item(s. Before shipment, we reserve the right to refuse or cancel any order for any reason. Confirmation of order receipt (such as an email confirmation) indicates that we have received your request, but does not signify acceptance of your order by EconoCrafts.

5.2 Right to Cancel Orders: EconoCrafts reserves the right to limit, refuse, or cancel any order at our sole discretion. This may occur, for example, if a product is mispriced, if we suspect an order is fraudulent or unauthorized, or under other circumstances we deem appropriate. If we cancel your order, we will notify you using the contact information provided and ensure you are refunded for any amounts charged.

5.3 Purchase Limits and Resale: The products sold on EconoCrafts.com are intended for personal use or use within your organization (such as schools, camps, etc.), and not for resale or export. We reserve the right to limit or prohibit orders that, in our judgment, appear to be placed with the intent of reselling the items or shipping them overseas by unapproved distributors. For example, we may restrict multiple large quantity orders from the same customer or shipping address. By placing an order, you represent that you are not purchasing our products for commercial resale or unauthorized distribution.

5.4 Payment Methods: We accept various payment methods as indicated at checkout (e.g., major credit cards, debit cards, and/or third-party payment providers). By providing a payment method, you represent that you are authorized to use that method and you authorize us (or our third-party payment processor) to charge the full amount of your order (including any applicable taxes and shipping fees) to that payment method. If your payment method cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled.

5.5 Billing Accuracy: You agree to provide current, complete, and accurate purchase and account information for all orders. If you create an account, promptly update any information (billing address, email, credit card numbers, expiration dates, etc.) that changes, so we can complete your transactions and contact you as needed. If we suspect a violation of this section (such as providing false billing information), we may cancel the transaction and notify you.

5.6 Order Confirmation and Invoices: After you place an order, we will send an email confirmation with your order details. This email is for your information and is not a guarantee of product availability. A digital or paper invoice will accompany your shipped order or be emailed to you. Please retain it for your records. If you need a replacement invoice or have questions about a charge, contact our customer service.

5.7 Order Cancellations by Customer: If you need to cancel or change your order, be sure to get in touch with us as soon as possible. We process orders quickly; while we will do our best to accommodate cancellation requests, we cannot guarantee that we can cancel an order once it has been placed. (Per our Refund Policy, orders can only be canceled or modified within one hour of submission.) If an order has already shipped, you may need to process a return instead (see Section 7).

6. Shipping and Delivery

6.1 Shipping Regions: EconoCrafts currently ships to addresses within the United States. (If international shipping is available, include applicable regions and any restrictions.) Please ensure that the shipping address you provide is correct and complete. We are not responsible for packages that cannot be delivered due to incomplete or incorrect addresses.

6.2 Shipping Methods and Timing: We offer various shipping options (standard, expedited, etc.) as displayed during checkout. Delivery times are estimates and not guaranteed. While we strive to meet the indicated delivery estimates, actual delivery may be affected by factors beyond our control (such as carrier delays, weather events, or holiday rush). EconoCrafts is not liable for any delivery delays once your package has been handed over to the carrier.

6.3 Shipping Costs: Shipping charges will be calculated and shown at checkout, and are paid by the customer as part of the order total (unless a free shipping promotion applies). Any import duties, customs fees, or tariffs for international shipments (if applicable) are the responsibility of the recipient.

6.4 Risk of Loss: All products purchased from EconoCrafts are made pursuant to a shipment contract. This means that title and risk of loss for the products pass to you upon our delivery of the items to the carrier. If a package is lost or damaged in transit, please notify us, and we will assist in working with the carrier to resolve the issue; however, such matters will be subject to the carrier’s policies and liability.

6.5 Delivery Confirmation: Upon shipping your order, we will provide a tracking number (via email or through your account) so you can monitor delivery status. It is your responsibility to receive the package at the provided address. If an order is marked as delivered by the carrier but you have not received it, please contact us and the carrier promptly to investigate.

6.6 Failed Delivery & Return to Sender: If a package is returned to us due to an inability to deliver (e.g., incorrect address, recipient unavailable), we will contact you for further instructions. Additional shipping fees may apply if the issue was due to a customer error and the package needs to be resent. If we cannot reach you, we may treat the order as canceled and refund you for the product (less any shipping costs incurred).

7. Returns and Refunds

7.1 Return Policy Overview: We want you to be satisfied with your purchase. Eligible items can be returned within 30 days of your receipt of the order, as long as they meet our return conditions. Our detailed Return, Refund, and Exchanges Policy (available on our website) is incorporated into these Terms. In case of any inconsistency, that policy will govern the specifics of returns and refunds.

7.2 Return Conditions: To be eligible for a return, items must be in the same condition as received – unused, unworn, with tags, and in original packaging. Certain products are non-returnable (for example, custom-made or personalized items, final sale closeouts, or hazardous materials as noted in our Return Policy). Please review the list of exceptions in our Return Policy if you are unsure.

7.3 Return Authorization: Before returning any item, you must contact us to obtain a Return Merchandise Authorization (RMA) number. Returns without an RMA may be refused. You can request an RMA by emailing us at orders@econocrafts.com with your order details and reason for return. We will provide instructions for sending the item back. Customers are responsible for return shipping costs unless the return is due to our error or a defective product.

7.4 Damaged or Incorrect Items: Please inspect your order upon delivery. If you received a wrong item, or a product arrives defective or damaged, notify us within 10 days of receipt. We will arrange for a return or exchange at our expense and provide instructions (often, we will send a replacement and a prepaid return label for the defective item). After 10 days, damage or incorrect-item claims may not be honored, or a restocking fee may apply.

7.5 Processing Refunds: Once your authorized return is received and inspected, we will process your refund. If approved, the refund will be issued to your original method of payment. Please note that original shipping charges are non-refundable (except when the return is due to our error). We aim to process refunds promptly, but it may take up to 10-15 business days for your bank or credit card company to post the credit. If you have not received a refund after 15 business days from our confirmation of return receipt, don't hesitate to get in touch with us.

7.6 Restocking Fee: If returns are initiated beyond the initial 10-day window for reporting issues, a restocking fee (typically 15% of the product price) may be deducted from your refund. This fee applies especially to late returns, as noted in our Return Policy.

7.7 Exchanges: If you wish to exchange a product for a different item or variant, please follow the return process for the original item (with an RMA). Once your return is accepted, you may place a new order for the desired item. We handle exchanges as separate transactions for inventory and accounting reasons.

7.8 Order Cancellations by Customer: (For reference, also see Section 5.7.) You may cancel your order within one hour of placing it by contacting us immediately, as we often process orders quickly. After that window, if the order has not yet shipped, we will try to accommodate cancellation requests, but we do not guarantee it. If the order has already shipped, it cannot be canceled – you would need to initiate a return instead.

8. Disclaimer of Warranties

8.1 “As Is” and “As Available” Basis: Except as explicitly stated in our policies (such as the Return Policy or any specific product guarantees), the EconoCrafts website and all products and services provided through it are offered on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.

8.2 No Additional Warranties: To the fullest extent permitted by law, EconoCrafts disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that: (a) the site will be uninterrupted, secure, or error-free; (b) the information on the site is accurate or reliable; (c) the quality of any products, services, or content obtained from the site will meet your expectations; or (d) any errors in the site or content will be corrected.

8.3 Consumer Law Exceptions: Note: Some jurisdictions do not allow the exclusion of certain warranties or limitations on how long an implied warranty lasts, so some of the above disclaimers may not apply to you. In such jurisdictions, our warranties are limited to the maximum extent permitted by applicable law.

8.4 Manufacturer Warranties: Many products we sell are manufactured by third parties. To the extent a manufacturer provides its own warranty, information on that warranty (if available) will be included with the product or on our website. EconoCrafts does not independently offer any guarantee of performance for products beyond what is stated in these Terms or our policies. Your sole remedy for defective products, except as provided under an express manufacturer’s warranty, is to return them in accordance with our Return Policy.

9. Limitation of Liability

9.1 Limited Liability: To the fullest extent permitted by applicable law, in no event shall EconoCrafts or its owners, officers, employees, affiliates, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, damages for lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the site or any products procured from the site, or for any other claim related in any way to your use of the site or purchase of products.

9.2 Cap on Liability: In no case shall EconoCrafts’ total aggregate liability for any claim or series of related claims arising out of or in connection with your use of the website or purchase of products exceed the amount you paid to EconoCrafts for the specific product(s) at issue. If your use of the site did not involve a purchase, EconoCrafts’ total liability shall not exceed one hundred US dollars (US $100). This is an essential term of this agreement.

9.3 Exceptions: Some states or jurisdictions do not allow the exclusion or limitation of certain damages. In such states, EconoCrafts’ liability shall be limited to the fullest extent permitted by law.

9.4 Release for Unforeseen Issues: You agree that EconoCrafts is not liable for any failure to perform or delay in performance of any obligation due to causes beyond our reasonable control (such as natural disasters, acts of war or terrorism, civil disturbances, supply shortages, strikes, fire, epidemics, or internet/service provider outages). In any such event, our obligations are suspended for the duration of the event, and we will make reasonable efforts to resume service as soon as feasible.

10. Third-Party Links and Tools

10.1 Third-Party Links: Our website may contain links to third-party websites or services that are not owned or controlled by EconoCrafts (for example, links to craft resources, partner sites, or social media platforms). These links are provided for your convenience or reference only. EconoCrafts does not endorse and has no control over the content, privacy policies, or practices of any third-party websites. Therefore, we assume no responsibility for any third-party materials or websites, or for any loss or damage that may arise from your use of them. If you leave our site via a third-party link, you do so at your own risk. We encourage you to review the terms and policies of any third-party site you visit.

10.2 Third-Party Tools and Features: We may provide you with access to third-party tools or features on our site (for example, an embedded chat service, product customization widget, or other integrations), which we do not monitor, control, or have input over. You acknowledge and agree that access to such tools is provided “as is” and “as available” without any warranties, representations, or endorsements. EconoCrafts shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use of third-party tools provided through the site is at your own discretion and risk, and you should ensure that you agree to the terms provided by the third-party provider of those tools.

10.3 Third-Party Content: Any opinions, advice, statements, or other information made available by third parties (including users) on our site are those of the respective author(s) and not of EconoCrafts. We do not guarantee the validity, accuracy, or reliability of any third-party content.

11. Indemnification

You agree to indemnify, defend, and hold harmless EconoCrafts and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from and against any and all claims, demands, losses, liabilities, damages, expenses, or costs (including reasonable attorneys’ fees) arising from or related to: (a) your use of the site or purchase of products; (b) your breach of these Terms or any policy incorporated by reference; (c) your violation of any law or the rights of a third party; or (d) content you post or submit (including any claim that your user content infringes a third party’s rights). EconoCrafts reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms and any separate agreements by which we provide you services or sell you products shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law principles, except to the extent superseded by U.S. federal law (for example, regarding arbitration).

12.2 Initial Resolution Efforts: We aim to address any concerns or disputes quickly and effectively. If you have an issue with a product or service, we encourage you to contact our Customer Care to seek an informal resolution. Most customer concerns can be resolved to mutual satisfaction through our support team.

12.3 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, enforcement, interpretation, or validity thereof, or your use of the website or purchase of products (collectively, “Disputes”), shall be resolved by final and binding arbitration. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in New Jersey, unless you and EconoCrafts mutually agree on an alternative location or telephonic/e-mail proceedings. You and EconoCrafts each waive the right to a trial by jury.

12.4 Class Action Waiver: You and EconoCrafts agree that any arbitration (or, if permitted, court action) will be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator shall not consolidate or join the claims of other persons or parties who may be similarly situated without the express consent of all parties. You hereby waive any right to participate in class actions, class arbitrations, or any representative proceeding against EconoCrafts.

12.5 Exceptions: Notwithstanding the foregoing arbitration provision, either party may choose to pursue a claim in small claims court if the claim is within that court’s jurisdiction and is filed as an individual claim. In addition, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of a party’s intellectual property or proprietary rights.

12.6 Arbitration Finality and Confidentiality: The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. All aspects of the arbitration proceeding, including but not limited to the award, shall be kept confidential by the parties, except as may be required for the enforcement of the award or as agreed by both parties.

12.7 Costs of Arbitration: Each party shall bear its own costs and attorneys’ fees, unless the arbitrator finds that a claim was frivolous or brought for an improper purpose (in which case the arbitrator may award attorneys’ fees to the prevailing party, to the extent permitted by law). The administrative costs of arbitration (e.g., AAA fees) will be allocated per the AAA rules, but we will pay any costs required by law or necessary to make the arbitration provision enforceable.

12.8 Severability of Dispute Clause: If any portion of this Section 12 (Governing Law and Dispute Resolution) is found to be unenforceable or unlawful (such as the class action waiver being found unenforceable), the unenforceable portion shall be severed, and the remaining provisions shall still be enforced. However, if the class action waiver is deemed invalid with respect to a particular claim and that claim proceeds on a class basis, then the entirety of the arbitration agreement shall be null and void for that claim.

13. Miscellaneous Provisions

13.1 Severability: If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

13.2 Termination of Terms: These Terms remain in effect unless and until terminated by either party. You may terminate your agreement with these Terms at any time by discontinuing use of our website and services (and, if applicable, by closing your account). EconoCrafts may terminate or suspend access to the site (or your account) at any time, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to our interests or another user. If terminated, the obligations and liabilities incurred prior to the termination date (including your responsibility to pay for any orders and our warranties or disclaimers) shall survive termination for all intents and purposes.

13.3 No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of EconoCrafts.

13.4 Entire Agreement: These Terms, together with any policies or operating rules posted on our site or expressly incorporated herein (such as our Privacy & Cookies Policy, Refund Policy, and any other policy referenced in these Terms), constitute the entire agreement between you and EconoCrafts governing your use of the site and purchase of products. It supersedes any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

13.5 Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. EconoCrafts may assign or transfer its obligations under these Terms in connection with a merger, sale of assets, reorganization, or by operation of law or otherwise. These Terms will inure to the benefit of and be binding upon each party’s respective successors and permitted assigns.

13.6 Headings and Interpretation: The section titles in these Terms are for convenience only and have no legal or contractual effect. In these Terms, the words “including” and similar terms are to be construed without limitation.

13.7 Force Majeure: EconoCrafts will not be liable for any delay or failure to perform any obligation in these Terms if the delay or failure is due to circumstances beyond our reasonable control, such as acts of God, natural disasters, war, terrorism, civil disturbances, supply chain interruptions, labor strikes, fires, epidemics, or power/internet outages.
